DTI warns OFWs vs franchising scam

MANILA, Philippines – Filipino migrant workers and their families were again warned against bogus franchisors duping them of their hard-earned money.

The Department of Trade and Industry (DTI) asked the foreign affairs department to issue an advisory to all Philippine posts to warn OFWs against rampant franchising scams.

The DTI specifically identified Fran.con Franchise Marketing and Consultancy, Inc., Hamoraon Business Specialist Inc., and Michelle Ann Pacubas-Chan (single proprietor) as bogus franchisors.

The trade department advises OFWs to contact the DTI Direct Hotline 751-3330 or the Franchising Associations and other relevant government agencies for verification of legitimate franchisors.

The DTI said it receives numerous complaints from victims of franchising scams, especially from OFWs.

Last March 23, the government agency held a dialogue with the Department of Labor and Employment, the Securities and Exchange Commission, the Overseas Workers Welfare Administration, the Philippine Overseas Employment Agency, Franchising Associations, and a number of complainants to assist and resolve the concerns of OFWs who would like to venture into the franchising business.

One of the measures agreed to address the issue is to conduct an intensive information campaign to alert and warn the public, especially OFWs, against bogus or fake franchisors.

  • The franchisor uses high-pressure sales tactics to convince you to buy their franchise. Often times a franchisor wants to pressure you through the sales process if they have something to hide and don’t want you to find out about it.
  • If the franchisor gives evasive answers to your questions. When you ask standard questions related to the franchise, the franchisor should be able to immediately be able to give you direct and straight-forward answers.
  • Steep franchise fees the franchisor can justify. Typically, a franchisor’s upfront fees are designed to cover their costs of recruiting new franchisors and helping them establish their franchise. The fees should not represent the franchisor’s primary method of generating a profit; this profit should come from back-end royalties generated by successful franchisees in the franchisor’s system.
  • No proper support organization. For franchising to be successful, it is necessary for the franchisor to create an organizational support like training, quality and standard compliance, research and development.
  • Improper selection of franchisees. Applying for a franchise takes and involves a process. The franchisor has an identified criteria which must be met prior to signing and accepting the applicant.
  • Cut and paste Franchise Agreement. The heart of the relationship is found in the franchise agreement. It contains principles in franchising as well as policies for both parties to observe.
  • Find out if there have been any lawsuits filed against the company. You can also talk to current franchisees to find out if the franchisor is up to no good or if they do all that they promise to do.

These are just a few of the questions you will need to assess in determining whether the franchise is a scam. Your outside advisors will be able to help you put aside your entrepreneurial burn to get into the game and assist you in conducting a proper due diligence on the opportunity. First of all, welcome to sulit.  You made a very good decision in joining the sulit community where you can comfortably do business right at the comfort of your home.

 

In response to your queries:

 

1.  Our company is BFAD registered.  Our BFAD license is prominently displayed in our store for all customers to see.

 

2.  Our produsts are locally manufactured.  You dont have to go to the trouble of verifying our manufacturer (unless you want have a product toll manufactured yourself).  BFAD had already done this for you BEFORE they grant us our license.

 

3.  Can you please post your cost analysis of your "traditional recipe" so we can meke a comparative analysis? 

 

4.  The mixing ratio is 1 part powder to 6 part crushed ice.

 

5.   Shelf life is 6 months from date of manufacture.

When it comes to starting a business, many people think of buying a franchise as a shortcut to success. While there is some truth to this, not all franchises are created equal, and not everyone is cut out to be a franchisee.

Is there a franchise in your future? Here are the advantages and disadvantages of buying a franchise and what to expect when buying a franchise to help you decide.

Advantages of Buying A Franchise

1) Lower Failure Rate - When you buy a franchise, you are buying an established concept that has been successful. Statistics show that franchisees stand a much better chance of success than people who start independent businesses; independent businesses stand a 70 to 80 percent chance of NOT surviving the first few critical years while franchisees have an 80 percent chance of surviving (Michael M. Coltman, Franchising in Canada: Pros and Cons, Self-Counsel Press).

2) Help with Start Up and Beyond - You get a lot of help starting your business and running it afterwards. Many franchises are, in fact, turnkey operations. When you buy a franchise, you get all the equipment, supplies and instruction or training needed to start the business. In many cases, you also get ongoing training, and help with management and marketing. Your franchise will reap the benefit of the parent company's national marketing campaigns, for instance.

3) Buying Power - Your franchise will benefit from the collective buying power of the parent company as the franchisor can afford to buy in bulk and pass the savings along to franchisees. Inventory and supplies will cost less than if you were running an independent company.

4) Star Power – Many well-known franchises have national brand-name recognition. Buying a franchise can be like buying a business with built-in customers.

5) Profits - A franchise business can be immensely profitable. (Think of Macdonalds and Tim Hortons, for instance.)

Disadvantages of Buying a Franchise

1) Their Way or The Highway - The main disadvantage of buying a franchise is that you have to do it their way - sometimes right down to the way the napkin holders are filled. As a franchisee, you are not the one actually running the show, and some franchisors exert a degee of control that you may find excruciating.

2) Ongoing Costs – Besides the original franchise fee, royalties, a percentage of your franchise’s business revenue, will need to be paid to the franchisor each month. The franchisor may also charge additional fees for services provided, such as the cost of advertising.

3) Ongoing Support? Not all franchisors offer the same degree of assistance in starting a business and operating it successfully. Some are just startup operations – and everything after startup is up to you. Others make promises of ongoing training and support that they don't follow up on.

4) Cost - Buying into well-known franchises is very expensive. If this is your choice, you will have to have extremely deep pockets or the ability to arrange the necessary financing.

Just because a business is offering franchises is no guarantee that the franchise you buy will be successful. In some cases, franchising is the business; all the franchisor is interested in is selling more franchises. Whether or not the individual franchises are successful is irrelevant to them. The Franchise Application

The first step in buying a franchise is to contact the franchisor operating a franchise that you’re interested in. Usually when you express an interest, the franchisor will expect you to complete a questionnaire or application form.

A franchisor will want to know about your personal assets, for example, because he or she wants to make sure you have a fall-back position to carry the business in case it runs into financial difficulty.

You will probably also be asked about your spouse’s financial situation. Once again, the franchisor wants to be sure that both of you are prepared to make the financial commitment necessary to start and run the franchise successfully.

If you “pass” the questionnaire or application test, the next step is usually a meeting with the franchisor that you can think of as a job interview. The franchisor will continue to explore your interest, commitment and suitability; you, on the other hand, will be trying to find out as much as possible about the franchise.

The Franchise Contract

If the franchisor decides you are a suitable franchisee, you will be offered a franchise contract that lays out the obligations of both parties. You should seek legal advice about the contract and go over it carefully. Like any other contract, some aspects of it may be open to negotiation. And like any other contract, if there are any promises made about the franchisor/franchisee relationship that are not in the franchise contract, get them written in.

I PLACED MY ORDER LAST OCT. 8, 2010, I DEPOSITED TO THEIR BANK AND I HAVE THE PROOF, BUT MY ORDER OF 1 KILO DID NOT ARRIVE YET, AND IT IS ALREADY OCT. 12, 2010, AM WONDERING IF HOW LONG DOES IT TAKE TO CALL MY SHIPPER AND HAVE MY ORDER FOR PICK UP? Hi Mr. Raffy Ignacio,

We are sorry for the delay (if indeed there is delay as I will point out later) but your order of  ONE (1) kilo Ice  Scramble Premix powder was finally picked up today October 13, 2010, by AP Cargo, Waybill No.918998689.

Your deposit was made on October 8, 2010, on a friday.  We were able to confirm your payment on Monday, October 11, 2010.  Shipment was not yet made on October 12, or 1 day after we confirmed the payment and you are already making a big fuss. 

Although we try very hard to immediately prepare our customers' orders, our limited manpower has resulted to a backlog of as much as 4 to 5 days for order preparation.  This is because we prioritize serving customers who come to our store.  This is not to say that we don't give priority to phoned-in or texted-in orders, but we are constrained to limit taking such kind of orders because of our limited capacity as of the moment.  Rest assured that we will strive to better accomodate our valued customers' needs.

thank you very much for accommodating, the only problem was, there was no proper communication since you mentioned that you will have it picked up by monday and when i followed up tuesday it was still not picked up, if you texted me that you were busy i could have understood your situation, but thank you for attending my order.

Just had my first full purchase (first was only to try the products) from this store about a week ago, and my experience was good enough to merit another purchase.

The product is good and the price is fair, a bit lower from the other suppliers. But what caught my attention was the superb service by the employees. They are very accomodating and efficient. They do not fail to answer queries in a courteous manner, generally their customer service attitude is very satisfactory if I may rate it, from the cashier to the sales people. I hope you sustain the right behaviour so that your customers will increase.

Being in the customer service industry myself, I can say that you guys deserve more customers in the coming days. Kudos!
