paano maglipat ng itulo ng lupa sa pangalan ng buyer

Hi! everyone! mayroon lang akong question regarding sa paglipat ng pangalan ng titulo ng lupa, actualy wala talaga akong alam sana can anyone answer my question.. may lupa kasi kami sa bulacan ngayon nabenta na sya ang umaayos kasi nito is yung tito ko kaya lang umalis na sya papunta sa ibang bansa so ako na ang magaayos ngayon which is wala nman akong background sa pagaayos ng lupa.. nabili na sya ang iniwan sa akin ay absolute deed of sale worth 200,000 nka notaryo na sya, and may CAR na din..ang gusto mangyari ng buyer kami na ang maglakad para mailipat sa pangalan nya.. paano po kaya ang susunod kung step since may deed of absolute sale na naka notaryo and CAR na? saan po kaya ako sunod na pupunta? and saan po kaya sa bulacan yun aayusin yun since ang lupa namin is located at san jose delmonte bulacan? sana po may maka tulong saakin.. 09435505442

Take the "Deed of Sale" or "Deed of Absolute Sale" to the Registry of Deeds to be officially recorded after paying the documentary stamp, transfer tax and registration fees.

The SELLER pays for the:

Capital Gains Tax equivalent to 6% of the selling price on the Deed of Sale or the zonal value, whichever is higher. (Withholding Tax if the seller is a corporation)
Unpaid real estate taxes due (if any).
Agent / Broker's commission.

The BUYER pays for the cost of Registration:
Documentary Stamp Tax - 1.5% of the selling price or zonal value or fair market value, which ever is higher.
Transfer Tax - 0.5% of the selling price, or zonal value or fair market value, which ever is higher.
Registration Fee - 0.25% of the selling price, or zonal value or fair market value, which ever is higher.
Incidental and miscellaneous expenses incurred during the registration process.

after the fees, you still have to wait for few days or weeks, for the original duplicate to be released by the Registry of Deeds.

Usually, by rule of thumb ay yung buyer ang dapat na maglipat nung land title sa pangalan niya dahil siya ang interested party. Not unless na nakalagay sa agreement na yung seller ang maglalakad ng paglilipat noon. Second: requirement sa paglilipat ng title ang capital gains tax; nabayaran na ba ito? Kung hindi pa, ay tingnan mo ulit kung kasama ito sa absolute deed of sale kung sino (seller or buyer) ang magbabayad nito. kapag wala doon, by rule of thumb ulit - ay dapat bayaran ito ng seller. By this scenario means mababawasan na agad yung 200,000 na pinagbentahan ng lupa dahil mapupunta ito sa capital gains tax. Kailangan mong magpunta sa Register of Deeds sa Munisipyo ng Bulacan para sa bagay naito; doon din sa kanila mo malalaman ang mga talagang kailangang mga dokumento para sa tranfer of title.
