Hello po! Nakita ko po etong posts sa forum nyo. May konti querries lang po ako, hope you can help me.

Yung lote po kasi owned by parents na pinamana nila sa 4 na anak nila. Pero yung title di pa nila na transfer o na subdivide sa kani-kanilang lote. Lahat po sila binebenta sa kani-kanilang lote na namana. Yung lote na gusto ko sana bilhin part lang ng minana ng isang anak...bale ganito po example yung lote na namana niya is 1000 sqm., so yung 350 sqm lang po ang bibilhin ko at ibebenta niya sa akin. Tanong ko lang po if di po ba ako magkakaproblema sa pagproduce ng title since di pa etong mga lote nakapangalan sa kanila? And its not the whole lot na minana niya ang bibilhin ko kundi partial lang.... PLease help me po ano po mga dapat kong gawin to check if its legal and paano po procedures dito sa pagproduce or transfer ng title since di pa eto na subdivide ng mabuti.

Di ka nyan mabibigyan ng title kase dapat masubdivide muna ang lupa at dun ibabase ng Register of Deeds yun titulo na ibibigay sau (which will specify the boundaries of your purchased lot).

ibig sabihin po kahit na fully paid na ako and apply for Title (attached OCT & Deed of sale) di parin po eto maprocess unless maibenta nila lahat yun then subdivide?

Hindi naman kelangan na mabenta nilang lahat yun. Ang importante ay masubdivide na ang lupa kase dun ibabase ng Register of Deeds yung exact location and measurement ng nabili mong lupa. Halimbawa sa 5,000 sq.m na lupa, nabili mo ang 300 sq.m. Kung hindi pa nasubdivide, di alam ng register of deeds kung saan ang kinalalagyan sa 5,000 sq.m. nung lupa mong 300 sq.m. Nakasaad yan sa Title up to the last detail. Kung di pa nasubdivide, walang basehan ng exact location 300 sq.m sa 5,000 sq.m.

Ahhh gets ko na po pero po dapat may official blueprint na sila ng subdivided lots di po ba? Ang nakita ko kasi na MAP nila ay sila lang po ang nagsubdivide, may kakilala kasi sila sa City Hall. In this case, malabo nga mabigyan ako ng title neto if tinuloy ko ang pagbili.

agree.

yun pag subdivide kasi is done by the city engineer's office only

kasi yan din yun gagamitin nila as prerequisite dun sa pag apply mo ng title.

pag sinukat kasi yan ng city engineers, hindi lang yan sukat sukat at face value tama sabi ni... (wait ikaw ba yun sa isang thread din?)

anyway, pag sinukat kasi yan ng city engineer's office may mga refrences yan like due north at mga bearings... etc... kasi every yard of that lot consrtitutes to the whole of the town which in turn constitutes the whole philippines etc. what i was trying to say legal at valid yun processing ng pagsukat ng lupa dahil magkamali sila dyan kahit 1 yard lang magkakaroon ng complication sa overall sukat nun area. Hindi lang yan pang pilipinas but international pa. hahahaha. anyway that's going over the subject and your concern.

Just to be safe, pasukat mo muna sa city enginneer's office dahil im sure in the future kung matuloy a man dyan ay appa title mo din.
