Goodmorning,I need advice,kumuha kc kami ng house ng husband ko but were on deposit payment palang di pa natatayo ang house going 10% na ung napapaid namin but unexpectedly we expirience financial problem and we need to withdraw it,anyone knew how namin gagawin un?and hindi ba mababawasan un binayad namin?we almost paid 100k maibibigay kaya agad samin un?please i need advice,were loosing much nasasakrifice narin ang mga kids ko,maihahabol pa kya nmin un? emoticonemoticonemoticonemoticonemoticonemoticonemoticonemoticonemoticonemoticonemoticon

ma'am may contract po kayo na pinirmahan check nyo kung pwede nyo ma refund kung sakali mag back out kayo . pero sa pag ka alam ko yun na ideposit nyo hindi nyo na makukuha na buo

kausapim nyo po yung sales agent nyo at maaaring makukuha nyo pa yan pero matagal at less na dhil sa mga processing fee.check nyo rin po dun sa pinirmahan nyong contract.hope dis help..

Thanks,wala pa po samin ung contract from the developer on process palang ung application namin sa bnk-financing,may pag-asa pa kaya kami mkuha un?

Hanap ka ng buyer na mag papatuloy nun pag deposit. Pwede naman ata i transfer yung ownership sa contract.

hanap ka ng buyer na sasalo sa house mo, kc kong walang sasalo e hindi na ibabalik sayo ang binayad nyo po.

Depende sa pag-uusap nyo pero alam ko hindi nyo na makukuha ng buo kasi nga nabawasan na dahil sa processing fee.

maam mababawasan po ung deposit cguro mababalik na lang sa inyo un 50% or less than if gus2 nyo di cya mabawasan hanap kayo ng buyer ng house then sa kanya mo ipatuloy ung pinapagawa nyong bahay maibabalik po sa inyo un ng almost 100%

50% nalang makukuha mo dyan.. depende na din sa contract na pinirmahan mo.. dapat binasa mo bago ka pumirma..andun lahat eh... kung may kopya ka alamin mo now...

wala pong pinakamaganda kundi ang kausapin nyo yung ka-deal nyo sa problema nyo. sila lang po makakasagot ng tanong nyo. puro haka haka lang po isasagot nila dito sa inyo. pag nakausap nyo na at hindi nyo gusto yung sagot ng ka-deal nyo, tsaka po kayo bumalik dito para magtanong kung ano dapat o pwede nyong gawin.

tama sana maam inisip mo muna bago ka kumuha ng house lalo na yan bigla ka nag karoon ng finacial problem meron ka pa pala pinag aaral sana inalam mo muna kung kakayanin mo ba kumuha ng ganung bahay kasabay ng pag papaaral mo sa mga anak mo... ngayon nag sisisi ka na at gusto mo withdraw lahat ng binigay mong pera pero maam wag ka po umasa na 100% babalik sayo un.. pero kung meron naman buyer makaka asa ka babalik sayo pera mo

Covered ka ng batas RA No. 6552 - Realty Installment Buyer Protection Act o mas kilala bilang Maceda Law.

Eto yung excerpts ng batas:

IN CASE LESS THAN TWO YEARS OF INSTALLMENTS WERE PAID:

  1. Seller shall give buyer a grace period of not less than sixty (60) days from the date the installment became due.
  2. If the buyer fails to pay the installment due at the expiration of the grace period, the seller may cancel the contract after thirty (30) days from receipt of the buyer of the notice of cancellation or the deman for rescission of the contract by notarial act.

OTHER RIGHTS OF THE BUYER:

  1. Buyer shall have the right to sell his rights or assign the same to another person. The deed of sale or assignment shall be done by notarial act.
  2. Buyer shall have th right to reinstate the contract by updating the account during the grace period and before actual cancellation of the contract.
  3. Buyer shall have the right to pay in advance any installment or the full unpaid balance of the purchase price at any time without interest and to have such full payment of the purchase price annotated at the title covering the property.

So sa case mo, tingnan mo kung umabot ka na ba ng two (2) years, pero definitely, di mo makukuha ng buo ang ibinayad mo.
