help regarding deed of sale

patulong naman po, pasensya na medyo ignorante. here is the situation:

im planning to buy a car, may nakita na ako and nakausap ko na rin ang seller,

yung car daw ay sa kamaganak nung seller na nasa abroad and pinapabenta sa kanila, (2nd owner na si kamag-anak, magiging 3rd ako)

yung papers kumpleto naman, ( Orig OR/CR named to orig owner + deed of sale+photo copy nung id ng orig owner and nung kamag-anak)

1. ang tanong po, di po kya ako magkakaproblema kung yung deed sale ay between lang dun sa kamag-anak and orig owner?

2. makakapagpagawa po kya ako ng deed of sale between me and kamag-anak without the presence of kamaganak.?

I guess to be legally safe, mas maganda kung meron siyang hawak na special power of attorney but in the absence of this document, the deed of sale signed by the original owner should be final and notarized, then you can make another deed of sale signed by the seller (kamag-anak) and ask for a photocopy of his gov't. issued ID (eg. driver's lic., passport, etc.). In addition, it would be better if the photocopies of the IDs will also contain 3 specimen signatures, the Certificate of Registration should also contain the signature of the original owner which you can find on the lower left hand corner of the said document, finally, you can verify LTO registration papers by personally going to the motherfile (LTO agency where vehicle is originally resgistered) and ask from the Records section if you could see the documents pertaining the vehicle.

It's hard to earn money, it's going to be even harder if you find out that what you have just purchased with it, is something that can be legally taken away from you. Konting sinop lang naman to avoid malaking sakit ng ulo. Cool
